In the letter 2nd read above, the Director General of Police, Andhra Pradesh, Hyderabad, has stated that, Adhoc rule was made with effect from 01.01.2008 for fixation of seniority of Police Constables in AR/SARCPL Police Constables who are appointed by transfer (by conversion) from APSP in terms of orders dt:08.10.2013 of Hon’ble High Court in W.P.Nos.26765/2011 and batch cases, by applying weightage formula for the purposes of further promotion in Armed Reserve vide G.O.Ms.No.01, Home (Legal.II) Department, dt: 07.01.2016 in the following manner:-

The seniority of Police Constables in Armed Reserve, appointed by transfer from Special Police Battalions shall be fixed giving weightage of one year of service for every completed two years of service rendered as Police Constables in Special Battallions, subject to a maximum of seven years.

Further, he has also stated that , in order to apply same analogy to PC (Civil) appointed by transfer (conversion) from PC ( AR/SAR CPL) there is need to frame rules in applying seniority to PC (Civil) who are appointed by transfer (Conversion), as there are different Service Rules that touch different cadres in the department and hence it is better to have uniform and common set of Rules so that there will be clarity of interpretation and execution of transfers by conversion from one category to another and at present, as per rule 10 Seniority (ii) (ii) of Andhra Pradesh Police (Civil Police) Subordinate Service Rules issued in G.O. Ms. No. 374, Home (Pol.C) Dept., dated 14-12-1999, the seniority of PCs of AR/SARCPL transferred to (Converted) to PCs (Civil) shall be determined with reference to their date of first appointment in the former category.

The Director General of Police, Andhra Pradesh, has requested to approve the following formula for fixation of seniority in respect of PCs of (Civil) (Men) appointed by transfer ( Conversion) from PCs ( AR/SAR CPL) (Men) duly issuing amendment to the Andhra Pradesh Police (Civil Police) Subordinate Service Rules issued in G.O. Ms. No. 374, Home (Pol.C) Dept., dated 14-12-1999 as amended from time to time keeping in view of the orders of the Hon'ble High Court dt: 08-10-2013 and G.O.Ms.No.01, Home (Legal-II) Dept, dt.7-1-2016:-

Rule 10 (ii) (ii) : 

The seniority in respect of PCs of (Civil) (Men) appointed by transfer (Conversion) from PCs (AR/ SAR CPL) (Men) shall be fixed as follows:

Shall be given a weightage of one year for every completed two years of service rendered as PC (AR / SAR CPL) (Men), subject to a maximum of seven years. For the purpose of calculation of weightage under this clause, fractions, if any are to be ignored.

Government after careful examination of the entire matter hereby approved the following formula as proposed by the Director General of Police, Andhra Pradesh, Hyderabad, for fixation of seniority in respect of PCs of (Civil) (Men) appointed by transfer ( Conversion) from PCs ( AR/SAR CPL) (Men).

Accordingly, the following notification is published in the Andhra Pradesh Gazette:

NOTIFICATION 

In exercise of powers conferred by the proviso to article 309 of the Constitution of India and of all other powers hereunto enabling, the Governor of Andhra Pradesh hereby make the following amendment to the Special Rules for Andhra Pradesh Police (Civil Police) Subordinate Service Rules issued in G.O.Ms.No.374, Home (Pol.C) Dept., dated 14-12-1999 as amended from time to time.

AMENDMENT 

• In the said rules the following shall be substituted in Rule 10 (ii) (ii), namely: 

Rule 10 (ii) (ii) : 

The seniority in respect of PCs of (Civil) (Men) appointed by transfer (Conversion) from PCs (AR/ SAR CPL) (Men) shall be fixed as follows:

"Shall be given a weightage of one year for every completed two years of service rendered as PC (AR / SAR CPL) (Men), subject to a maximum of seven years. Note: For the purpose of calculation of weightage under this clause, fractions, if any are to be ignored."
